Were you hurt in a car wreck, slip and fall, or any other accident in Anchorage? Alaska gives you two years to file a personal injury claim under AS § 09.10.070. The state uses a pure comparative fault rule. Even if you share some of the blame, an insurer may use that to reduce what you recover. Call Alexander Shunnarah Trial Attorneys for a free case review.

Alaska Laws That May Affect Your Case

In Alaska, the personal injury statute of limitations is two years. AS § 09.10.070 sets that deadline. The countdown begins on the day of your accident.

Alaska follows a pure comparative fault rule under AS § 09.17.060. This means fault could be split between the parties involved. Unlike other states, Alaska won’t cut off your claim entirely just because you were partly at fault.

However, insurers will still use it against you. They may argue you were speeding, distracted, or could have avoided the crash. Our attorneys fight for what you deserve. They can challenge the narrative.

Did your accident involve a Municipality of Anchorage vehicle or a road defect on a public street? A shorter deadline applies. Under AS § 09.65.070, claims against Alaska municipalities require written notice within 120 days of the injury. That’s well before the two-year window closes.

A Note for Our Military Community

Anchorage is home to Joint Base Elmendorf-Richardson (JBER). The base is one of the largest combined Army and Air Force installations nationwide. If your accident involved a federal employee, a military vehicle, or federal property, Alaska state rules don’t apply.

Instead, the Federal Tort Claims Act governs your claim under 28 U.S.C. § 2401(b). You must file an administrative claim with the right federal agency within two years. You can’t file a lawsuit until the agency denies the claim, or six months pass without a response.

The best thing you can do for your personal injury case is to speak with an attorney. Don’t risk your case for a missed deadline or a simple mistake.

Why Accidents Happen on Anchorage Roads

Living in Alaska is unpredictable. Add in long winters, black ice, and months of limited daylight, and the roads turn deadly fast. According to data from the Alaska Department of Transportation & Public Facilities (DOT&PF), Anchorage experienced as many as 3,120 traffic collisions. Common accident sites include the Seward Highway, the Glenn Highway, and Northern Lights Boulevard.

The Seward Highway runs 127 miles from Anchorage to Seward. Narrow and winding, the road hugs cliff faces and the waters of Turnagain Arm for much of the route. Tourist traffic spikes in summer. Ice and low visibility take over in winter. All of this creates dangerous conditions for car accidents.

Then, Glenn Highway connects Anchorage to the Mat-Su Valley. It carries some of the heaviest commuter traffic in Alaska. Black ice forms regularly, and steep grades make braking hard, especially for trucks.

Northern Lights Boulevard is one of Anchorage’s busiest urban roads. Drivers must deal with high traffic volume and fast-moving intersections. Rear-end crashes and serious collisions are common. The danger increases in winter when roads stay dark and slick for months.

Evidence disappears quickly after a crash, especially in Alaska. Speak with an attorney before you talk to any insurance adjuster. Anything you say to the insurance company may be used against you later.
