Were you hurt in a car wreck, workplace accident, or any other injury in Oklahoma City? Oklahoma gives you two years from the date of the injury to file a claim under Okla. Stat. tit. 12, § 95(A)(3). Oklahoma follows a modified comparative fault rule. If an insurer proves you were at least 50% responsible, you may lose your right to compensation. Call Alexander Shunnarah Trial Attorneys today.

Oklahoma Laws That May Affect Your Case

In Oklahoma, the personal injury statute of limitations is two years. Okla. Stat. tit. 12, § 95(A)(3) sets that deadline. The countdown begins on the date of your injury. If you miss it by even one day, the court could dismiss your case, regardless of the evidence.

Oklahoma follows a modified comparative fault rule under Okla. Stat. tit. 23, § 13. This means that fault in an accident could be split among all involved. If your share is less than 50%, your recovery is reduced by that amount. But if an insurer pushes that number to 50% or higher, you may not recover anything at all.

Unfortunately, adjusters use this rule to their advantage. They may argue that you were speeding or distracted. Our attorneys could fight to protect what you’re owed.

Did your accident involve an Oklahoma City vehicle, a state highway defect, or any government-owned property? Then, a different process applies. Under the Oklahoma Governmental Tort Claims Act, Okla. Stat. tit. 51, § 156, you must file a formal notice of claim with the appropriate government entity. Plus, this must be filed within one year before you file a lawsuit. The government then has 90 days to respond.

A Note for Our Military Community

Oklahoma City is home to Tinker Air Force Base, one of the largest Air Logistics Complexes in the Air Force. Did your accident involve a military vehicle or property on a federal installation? Then, the Oklahoma state rules may not apply.

The Federal Tort Claims Act governs your claim under 28 U.S.C. § 2401(b) instead. You must file an administrative claim with the appropriate federal agency within two years. You cannot file a lawsuit until the agency denies the claim, or six months pass without a response.

The best thing you can do is to speak with a personal injury attorney. They can advise you on what to do next.

Why Accidents Happen on Oklahoma City’s Roads

Founded in 1889, Oklahoma City is Oklahoma’s state capital. The city sits at the crossroads of three major interstates: I-35, I-40, and I-44. The traffic load shows every day. According to the Oklahoma Highway Safety Office (OHSO), Oklahoma County recorded 21,403 accidents in 2021. There were 66,074 crashes recorded across the state in that same year.

Common accident sites include Interstate 240, the I-40 and I-44 interchange, and Interstate 35.

Interstate 240 (I-240) is the main commuter bypass for southern Oklahoma City. This interstate connects I-44, I-35, and Will Rogers World Airport across 16 miles. Poor spacing between on- and off-ramps forces drivers to merge and exit quickly. Heavy commercial truck traffic also increases the risk of accidents.

The Crosstown Expressway meets the Turner Turnpike at the I-40 and I-44 interchange downtown. Speeding drivers entering and exiting on ramps have little room for error. It is also one of ODOT’s most active wrong-way detection corridors.

Then, Interstate 35 (I-35) carries heavy truck traffic north and south through Oklahoma City. It connects the metro to Norman, Moore, and communities farther south. ODOT flagged the outdated cloverleaf design at I-35 and I-240 as a safety priority.

In Oklahoma City, evidence disappears quickly after a car accident or truck wreck. Protect your claim by meeting with a personal injury attorney.

Common Questions About Personal Injury Claims in Oklahoma

Have you been injured in an accident in Oklahoma? Our law firm is ready to provide clear legal guidance. These are the most common questions we receive from people like you.

Your health and safety come first. Seek medical attention, even if you feel okay. Some injuries don’t show up for days. Then, you should document the accident as much as you can, including photographs and witness information. Meet with a personal injury attorney before speaking to an insurance adjuster.

In most cases, you have two years from the date of your injury under Okla. Stat. tit. 12, § 95(A)(3). But if a government vehicle, road defect, or public employee was involved, a different process applies. The Oklahoma Governmental Tort Claims Act sets this rule. You must file a formal notice of claim with the government entity within one year of the injury before you can file a lawsuit.

Most law firms, including Alexander Shunnarah Trial Attorneys, work on a contingency fee basis. You pay nothing unless we win a settlement or verdict in your favor. Your first case review is always free.

It depends on the facts of your case. Oklahoma allows injured people to receive compensation for medical bills, lost wages, future medical treatment, and pain and suffering. Your share of responsibility reduces what you may receive under Oklahoma’s comparative fault rule.
