Were you hurt in a car wreck, workplace accident, or any other injury in Fargo? North Dakota gives you six years from the date of the accident to file a claim under N.D.C.C. § 28-01-16. The state follows a modified comparative fault rule. If an insurer proves you were at least 50% responsible, you may lose your right to compensation. Call Alexander Shunnarah Trial Attorneys today.

North Dakota Laws That May Affect Your Case

In North Dakota, the personal injury statute of limitations is six years, as set by N.D.C.C. § 28-01-16. This is one of the longest windows for a claim nationwide. The clock starts on the date of your injury.

But a longer deadline doesn’t mean you should wait. Evidence disappears, and witnesses move on. The insurance company begins to build its case as soon as the accident happens.

North Dakota follows a modified comparative fault rule under N.D.C.C. § 32-03.2-02. Fault in an accident could be split between the parties involved. If your share is less than 50%, your recovery is reduced by that amount. But if an insurer pushes that number to 50% or higher, your claim may be barred entirely.

North Dakota is also a no-fault auto insurance state. This means that your own insurance covers initial medical costs, regardless of who caused the crash. However, pushing for compensation for pain and suffering requires that you meet a specific injury threshold.

Did your accident involve a City of Fargo vehicle, a state-maintained highway defect, or any government-owned property? Then, a shorter deadline may apply to your case. Within 180 days of the injury, claims against North Dakota state agencies must be presented in writing to the Office of Management and Budget.

Why Accidents Happen on Fargo’s Roads

As North Dakota’s largest city, Fargo sits where Interstate 29 and Interstate 94 cross. It’s one of the most important trucking intersections in the northern Great Plains. Harsh winters, icy roads, and high commercial truck volume all push the city’s crash numbers up year after year. According to the North Dakota Department of Transportation (NDDOT), the state experienced 9,803 vehicle crashes in 2024.

According to the same North Dakota Department of Transportation report, Cass County had 2,511 crashes. That is almost a third of the state’s vehicle accidents. Common accident sites include 45th Street South, Interstate 94, and Interstate 29.

45th Street South is home to two of the most dangerous intersections in North Dakota. First, the intersection at 13th Avenue South and 45th Street recorded over 70 crashes between 2018 and 2020. Nearly half of those crashes happened in wet or snowy conditions. Then, the intersection at 23rd Avenue South and 45th Street recorded another high number of crashes. Traffic and winter weather both often cause accidents.

Interstate 94 (I-94) is one of the most dangerous highways in North Dakota. It connects Fargo to Minneapolis and the rest of North Dakota. Speed, distracted driving, and winter road conditions consistently trigger collisions.

Running north to south, Interstate 29 (I-29) passes directly through Fargo. Commercial semi-trucks are common, and the northern sections are prone to closures during winter storms. Rollovers are often reported.

Common Questions About North Dakota Personal Injury Claims

Injured in Fargo? You’re most likely overwhelmed and confused. These are the most common questions we receive from clients in Cass County.

The first thing you’ll want to do is to get medical attention, even if you feel okay. Then, document as much of the scene as you can. Take photos, write down what happened, and collect the other driver’s information. Do not give a recorded statement to any insurance adjuster before talking to an attorney.

For most personal injury claims in North Dakota, you have six years from the date of your injury under N.D.C.C. § 28-01-16. That’s one of the longest windows in America. But evidence disappears quickly. The longer you wait, the harder it becomes for an attorney to build a case.

Our Fargo attorneys handle a wide range of personal injury cases, mass torts, and insurance disputes. In Fargo, we regularly handle car accidents, slip and falls, wrongful death claims, and catastrophic injury cases. If you were hurt because of another’s carelessness, you should speak with an attorney.

Many Fargo law firms, including Alexander Shunnarah Trial Attorneys, work on a contingency fee basis. You pay nothing unless we win a settlement or verdict in your favor. Your first case review is always free.
